Legal Framework

According to Section 3 No. 63 EStG, contributions to company pension plans are tax-free up to € 7,728 per year (2025). Contributions of up to € 3,864 per year are exempt from social security contributions (2025). Employees also have a statutory entitlement to deferred compensation in accordance with Section 1a BetrAVG. This allows them to convert part of their salary into a company pension plan, while the company pays at least a 15% subsidy, provided that social security contributions are saved.
