Maternity Protection Finally Gets an Update: Since January 1, 2025, new legal adjustments ensure that the protection of pregnant and breastfeeding mothers is more targeted than ever. What’s New in Maternity Protection?

The new regulations introduce several important changes, with different measures coming into effect at different times:

  • Adjustment of Risk Assessments: Since January 1, 2025, employers can, under certain conditions, waive the independent risk assessment if it is clear that pregnant or breastfeeding women cannot perform certain tasks.
  • Extended Protection in Case of Miscarriage: From June 1, 2025, women who experience a miscarriage from the 13th week of pregnancy will receive a staggered protection period – for example, up to two weeks from the 13th week, up to six weeks from the 17th week, and up to eight weeks from the 20th week.
  • Uniform Regulations for Stillbirths: In the case of a stillbirth from the 24th week of pregnancy, a uniform maternity protection period of 14 weeks will apply.
  • Extension to Civil Servants and Soldiers: Civil servants and soldiers will also benefit from improved protections, ensuring maternity protection applies across all relevant work sectors.
